Health Law

Health law governs the relationship between patients, healthcare institutions and healthcare professionals, patient rights, and liability arising from medical interventions. Our office provides legal support to patients and their relatives in disputes arising from alleged medical malpractice, as well as to healthcare professionals.

Main topics

  • Pecuniary and non-pecuniary damages arising from medical malpractice
  • Applications concerning violations of patient rights
  • Disputes arising from lack of informed consent
  • Cases against private and public healthcare institutions
  • Matters concerning the civil and criminal liability of healthcare professionals

General information on the process

The route for a medical malpractice claim depends on where the treatment took place. Claims against private healthcare institutions are brought before the civil courts; claims against public hospitals are brought before the administrative courts after an application to the administration.

In these cases, the patient's medical records and an expert examination play a decisive role. Obtaining complete records of the treatment is the first step in conducting the process properly.

Guide

What should I do first if I suspect a medical error?

The patient or their legal representative has the right to request a copy of all treatment records from the healthcare institution. The discharge summary, surgical notes, test and imaging results and prescriptions are the most important of these. These documents are the basic evidence for assessing the incident and for any possible lawsuit.

What is informed consent?

Informed consent means that the patient is told in advance about the nature, risks, possible complications and alternatives of the treatment or intervention, and gives approval on that basis. Interventions carried out without the necessary information may give rise to legal liability even if they were medically correct.

The information in this section is general in nature and does not constitute legal advice. The specific circumstances of each case must be assessed individually.
